Sofia Vergara has opened up about the embryo lawsuit with her ex-fiancé, businessman Nick Loeb. Although the suit was filed last year, the news only came to light last month. The 42-year-old Modern Family star has remained silent about the suit since the news broke but she has spoken out whilst appearing on Howard Stern's SiriusXM show on Monday (4th May).

Loeb is attempting to legally be allowed to bring two fertilised female embryos to term. The two embryos were frozen in 2013 when Vergara and Loeb were in a relationship. Loeb, who issued an op-ed in the New York Times, claimed he would take full responsibility for any children born from the embryos.

However, the two signed a contract in which they agreed that the embryos would remain frozen unless both parties agreed the embryos would be brought to term. Loeb is attempting to overthrow this contract, reportedly claiming the contract did not stipulate what would happen to the embryos if he and Vergara separated. 

The contract is the major point of contention for Vergara who stated, in her interview, that she "didn't do anything wrong." She emphasised that Loeb had signed the contract twice (once for each time the two embryos were frozen) and that he virtually "can't do anything" as he is tied by the contract. 

"There is a contract," she said. "He can't do anything . We did it two times. You make the mistake the first time. Two times? And suddenly now you want to change your mind? You have to follow what you sign!"

Vergara further argued that it would be "selfish" to bring a child into the world in the situation she and Loeb are in. 

"A child needs a mother and a loving relationship with parents who don't hate each other," Vergara said. "I don't hate him [Loeb] but obviously he has a problem. A kid needs parents. I wouldn't want to bring kids to the world where it's already set against them. It would be so selfish." 

Fortunately, Vergara is not letting the situation get to her. She has moved on and is engaged to Magic Mike's Joe Manganiello. The couple became engaged last December after less than a year of dating. Vergara explained how she tries not to talk about the situation with Manganiello and that they are having "so much fun" with their plans for the future. 

"Joe and I try not to even talk about it," Vergara said. "We have lawyers. We're having so much fun right now. We just moved into a new house. We're planning a wedding. We try not to think about this, we can't do anything. It's signed, it's done, and that's it."
