The children of comedian James McNair have reached an out of court settlement with Wal-Mart. McNair, known as Jimmy Mack, was killed on June 7th 2014 when a Wal-Mart employee, driving a company truck, caused a traffic accident involving six cars. The $10 million settlement will be split between McNair's two children, 19-year-old Danita and 26-year-old Jamel.

McNair and comedian Tracy Morgan were driving back to New York from Delaware on 7th June when a Wal-Mart truck driver drove into the back of Morgan's limousine. The collision also involved six other vehicles and claimed the life of McNair. Morgan, who frequently collaborated with McNair, was injured and hospitalised for a number of weeks. In November, it was revealed Morgan has sustained a brain injury during the crash and was still undergoing treatment and therapy. Three other passengers also sustained injuries and, along with Morgan, are suing Wal-Mart. 

Morgan and the other passengers alleged Wal-Mart was negligent in their suit. The crash raised a number of questions surrounding the Wal-Mart's policies and practices including how long the driver, Kevin Roper, had been driving for that day, seemingly on very little sleep. 

Few details regarding the McNair settlement have been revealed and both parties appear to have attempted to ensure the proceedings were remained private and confidential. 

"We are glad to have reached an agreement but we can't discuss the terms and conditions of the settlement," a Wal-Mart spokesman said. "We deeply regret the loss of Mr. McNair as a result of the accident."
