James MCNair, aka Jimmy MACk, died in June (14) when a truck driven by Wal-Mart superstore employee Kevin Roper collided with the stars' limousine in New Jersey.

His family planned to take legal action against Wal-Mart for the incident, amid accusations Roper had been sleep deprived at the time of the crash, but they agreed not to pursue the claim in January (15) after reaching a financial deal with superstore bosses, clearing them of any liability.

The details were kept confidential at the time, but the figure has since been disclosed in court papers filed in New York by the MCNair family lawyer, who is seeking almost $3 million (£1.88 million) more in legal fees.

Driver Roper, who was accused of falling asleep at the wheel at the time of the collision, was hit with criminal charges over the crash. He pleaded not guilty to one count of death by auto and four counts of assault by auto last year (14).

Morgan, who is still recovering from brain trauma and a broken leg, ribs and nose sustained in the crash, filed his own federal lawsuit for negligence against Wal-Mart in July (14). His suit has been temporarily put on hold due to Roper's criminal case.
