Levert's Widow Wins $4 Million Over Jail Death

The widow of R&B singer Sean Levert has won a $4 million (GBP2.7 million) settlement in a lawsuit over the entertainer's 2008 death in an Ohio jail.

Angela Lowe filed a wrongful death lawsuit against Cleveland prison officials, accusing them of neglecting Levert's medical needs, citing Levert was denied his prescribed anti-anxiety medication while behind bars for failing to pay $90,000 (GBP60,000) in child support.

Lowe reached an agreement with Cuyahoga County and a jail medical services contractor in Cleveland federal court on Wednesday (16Jun10). The terms of the deal include no official admission of liability.

A coroner ruled Levert, the son of The O'Jays star Eddie Levert, had died of natural causes, citing lung disease, heart disease, high blood sugar and withdrawal from anti-anxiety drug Xanax as the reasons for his death.

No Criminal Conduct In Levert's Death

LATEST: Prosecutors investigating the death of R+B singer Sean Levert have ruled out any suspicion of criminal conduct.


The 39-year-old son of The O'Jays star Eddie Levert fell unconscious while behind bars at Cuyahoga County Jail on 30 March (08), where he had been serving a sentence for failing to pay child support.


He was taken to the local Lutheran Hospital, but was pronounced dead less than an hour later.


His widow, Angela Lowe, filed a wrongful death lawsuit against Cleveland prison officials, accusing them of neglecting Levert's medical needs.

The 39-year-old son of The O'Jays star Eddie Levert fell unconscious while behind bars at Cuyahoga County Jail on 30 March (08).


He was taken to the local Lutheran Hospital, but was pronounced dead less than an hour later.


A coroner ruled he died of natural causes and it was revealed he suffered from heart disease and high blood sugar levels.

The 39-year-old son of The O'Jays star Eddie Levert collapsed in his cell at Cuyahoga County Jail in Cleveland on 30 March (08).


He was taken to the local Lutheran Hospital, but was pronounced dead less than an hour later.


On Thursday (29May08), a coroner ruled he died of natural causes and it was revealed he suffered from heart disease and high blood sugar levels.

LATEST: R+B singer Sean Levert died of natural causes, an Ohio coroner has ruled.


The 39-year-old son of The O'Jays star Eddie Levert collapsed in his cell at Cuyahoga County Jail in Cleveland on 30 March (08).


He was taken to the local Lutheran Hospital, but was pronounced dead less than an hour later.


And in autopsy results published on Thursday (29May08), the Cuyahoga County Coroner found that Levert suffered from a variety of illnesses, including heart disease and high blood sugar. The report claims there was no suggestion of foul play or trauma involved in his passing, reports website TMZ.com.

Fbi To Look Into Levert's Death

LATEST: The family of R+B singer Sean Levert is calling on the FBI to launch an investigation into the star's death, because they are not convinced by reports of his "out of control" behaviour shortly before his passing.
The 39-year-old son of The O'Jays star Eddie Levert collapsed in his cell at Cuyahoga County Jail on Sunday (30Mar08) night and was taken to Lutheran Hospital, where he was pronounced dead less than an hour later.
He had been serving a 22-month prison sentence for failing to pay $89,025 (GBP44,513) in child support to the mother of his kids.
On Tuesday (01Apr08), prison warden Kevin MCDonough revealed how Levert had to be physically restrained by guards, because he had been pounding on his cell door.
MCDonough claims Levert "willingly" co-operated with staff, but after being strapped to a restraining chair, his breathing slowed and he was rushed to hospital for treatment.
But Levert's cousin Michael Gibson claims the outburst described by MCDonough was out of character for his relative, and the family has called in the authorities to look into the case.
Scott Wilson, a spokesman for the FBI, has confirmed agents are to meet with the Levert family to discuss the case further.
The Cuyahoga County Coroner is currently waiting on results from toxicology tests after an initial autopsy proved inconclusive.

LATEST: R+B singer Sean Levert had to be physically restrained by prison guards because he was "out of control" shortly before he collapsed and died.
The 39-year-old son of The O'Jays star Eddie Levert collapsed in his cell at Cuyahoga County Jail on Sunday (30Mar08) night and was taken to hospital, where he was later pronounced dead.
He was being held behind bars after allegedly failing to pay $80,000 (GBP40,000) in child support to the mother of his kids.
Now website TMZ.com is reporting that Levert had been "hallucinating" late on Sunday, and had to be strapped to a restraining chair because prison staff were convinced he posed a danger to himself and others.
Jail warden Kevin MCDonough claims Levert co-operated with staff and "went willingly" when he was taken from his cell to have his wrists bound and feet shackled.
The Cuyahoga County Coroner has admitted there were no signs of physical trauma on Levert's body and his death is not considered suspicious. He is believed to have suffered from high blood pressure, but jail officials claim they were unaware of any health condition he may have had.
They are currently waiting on results from toxicology tests to determine Levert's exact cause of death.
Sean's death is the second to hit the Levert family in two years - his brother, R+B legend Gerald Levert, passed away in November 2006, aged 40, following an accidental drug overdose.
In a statement released on Monday night (31Mar08), the Levert family says, "There is no song that can capture the loss that we have in our hearts."

Sean Levert, who formed 1980s US pop group LeVert with his brother Gerald, has died in hospital after falling ill in prison.

The 39-year-old was taken to an Ohio hospital on Sunday when he became ill in a Cleveland jail.

Levert, the son of O'Jays vocalist Eddie Levert, had been sentenced to serve one year and ten months in prison for failing to pay thousands of dollars in child maintenance.

An autopsy has proved inconclusive, police said, but any suggestion of murder has been comprehensively ruled out.

Jail warden Kevin McDonough said guards had been observing Levert, who suffered from high-blood pressure for several days after he complained of hallucinations.

"There was nothing that would show any of this," he said. "He had an illness while he was here and it turned into an emergency at that time."

Toxicology reports could take more than a month to be completed, the warden added.

LeVert – comprised of brothers Sean and Gerald and their friend Marc Gordon – had a UK top ten hit with Casanova in 1987.

Eddie Levert, 65, has lost both his sons within the last two years. Gerald Levert died aged 40 in 2006 after an overdose of prescription drugs.

Legendary soul/funk singer Eddie Levert is mourning the loss of his son SEAN, who died after collapsing in a Cleveland, Ohio jail on Sunday (30Mar08).
Sean, who was a member of 1980s group LeVert, was being held at the Cuyahoga County Jail after reportedly failing to pay $80,000 (GBP40,000) in child support.
It is believed he collapsed in his cell late on Sunday night and was rushed to a local hospital, where he was pronounced dead, according to TMZ.com.
The Cuyahoga County Coroner is currently looking into the cause of death. The warden of the jail claims prison officials were unaware of any health condition he may have had.
The tragedy is the latest to hit the Levert family - Sean Levert's older brother, the R+B star Gerald Levert, died in November 2006, aged 40, following an accidental perscription drug overdose.
