*file Photo* * LOHAN GETS PROBATION FOR THEFT CHARGE, MUST SERVE JAIL TIME FOR PAROLE VIOLATION LINDSAY LOHAN has escaped further punishment over a misdemeanour theft charge, but it won't keep the actress out of jail. The Mean Girls star was sentenced to serve 120 days behind bars and 480 hours of community service in April (11) for violating her probation after she was accused of stealing a necklace from a California jewellery store in January (11). Los Angeles court Judge Stephanie Sautner ruled her arrest over the incident broke the terms of her parole, stemming from a 2007 DUI count. During that hearing, Lohan pleaded not guilty to the theft allegations and a trial date was set for 3 June (11). But the issue is no longer heading to trial - Lohan's lawyer, Shawn Holley, returned to court on Wednesday (11May11) to withdraw her appeal to the probation violation sentence, and change the plea to no contest. Judge Sautner declared Lohan, who was not present for sentencing, will not be handed an additional jail sentence for the theft charge. Instead, she has placed the star on three years parole, in addition to the jail term and community service. Lohan must surrender to authorities on or before 17 June (11) to begin her latest stint behind bars. However, Judge Sautner has left it up to the Los Angeles County Sheriff's Department to decide if she is eligible for early release to complete the sentence under house arrest with an electronic monitoring device. The actress must also attend a shoplifters course and undergo psychological counselling after her jail term, after which her DUI probation will be terminated. And Holley insists her famous client is ready to serve her time and put the whole case behind her without fuss. Speaking after the sentencing, Holley told reporters, Lindsay is not requesting or expecting special treatment (from authorities).
