The Australian actress has become a front-runner for a leading role in the project following Sophia Vergara's departure from the film, which will be the first directed by Lee Daniels since his work on 'Precious'.
The movie tells the tale of a reporter and his brother who investigate a murder to help a man on death row, and Nicole would play the role of a woman who writes letters to men who are set To Die For their alleged crimes.
Shooting has already been put back because of Tobey's departure, as it was due to start in the coming months.
Oscar-winner Nicole has a number of movies in the pipeline - she recently completed 'Trespass' with Nicolas Cage and Cam Gigandet and is also set for biopic 'The Danish Girl' about painter Einar Wegener.
