Sherri Shepherd is now fighting two custody battles.

'The View' co-host's first husband, Jeffrey Tarpley, has filed documents in court to gain full custody of their 9 year-old son Jeffrey, People reports.

The magazine obtained the court documents, filed in April in Los Angeles Superior Court, which show that Tarpley is trying to get an emergency custody modification hearing, claiming their son was suffering from "neglect."

A LA judge involved with the case didn't find any reason for a temporary emergency order, but did schedule a hearing for July 21st, according to the documents.

Tarpley claims their child, who has special needs, can barely read or write, is unable to tie his own shoelaces and has poor hygiene.

The comedian is seeking temporary custody of their son, and wants Shepherd to have "no visitation until the court rules on this issue at the hearing." He puts blame on the 47 year-old host's busy work schedule, which has "caused her to neglect Jeffrey and deprive him access to basic educational needs, a nurturing and loving environment, and care that Jeffrey so desperately needs."

When referring to her career on the small-screen, Tarpley adds it "is seven days per week non-stop," and accuses her of giving "primary responsibility for our minor child to unskilled nannies."

TMZ reports, Shepherd has filed her own document papers, declaring that Jeffrey is an absent father who isn't fit to look after their 9 year-old boy.

Tarpley's court documents were filed a month before Shepherd's current husband, Sally, filed for legal separation. In these papers it is revealed that the couple are expecting a child via surrogate, but now Sally wants full legal and physical custody of their unborn child, and only wants Shepherd to have visitation rights, once the surrogate gives birth which is due on July 29th.
