Kalimba - Prosecutor Appealing Kalimba Release
A prosecutor involved in the rape case against Mexican singer KALIMBA has appealed a judge's decision to free the singer.
The pop star, full name Kalimba Marichal Ibar, is accused of sexually assaulting a 17-year-old girl in a Quintana Roo hotel in December (10).
He was deported from America to Mexico in early January (11) to face the charge, but a judge dismissed the case last week (ends28Jan11) due to insufficient evidence to take it to trial.
But prosecutor Francisco Alor is objecting to the ruling and has vowed to fight the decision, insisting the appeal is "based on the overriding interests of the minor, international treaties on protecting minors and in view of the opinions of the human rights commission".
The singer, 28, has protested his innocence.
