Michael Madsen has been charged with two counts of driving under the influence (DUI).
The 'Reservoir Dogs' actor was arrested in Malibu in September after being stopped for driving erratically and subsequently blowing a .20 on a breathalyser test - more than twice the legal limit - and last Wednesday (05.12.12), the Los Angeles City Attorney filed two misdemeanour counts against him, one for driving under the influence of alcohol or drugs, and another for driving with a BAC of .08 or higher, gossip website TMZ reports.
The case is scheduled to go before the court later this month, but Michael's attorney - who previously declared the breathalyser test ''flawed'' - said: ''We intend to vigorously defend the charges.''
If convicted, the 55-year-old actor could face up to two years in jail but as he has no previous DUI convictions, it is unlikely he would serve any time in prison.
This is not the first legal problem the star has faced this year.
Michael was arrested in March on felony charges of child endangerment with cruelty to a child after an argument with one of his sons at his Malibu home.
Mug shot pictures of the star - who shares the house with his wife Deanna and their three sons - showed him looking disheveled and Sheriff's Deputy Peter Gomez confirmed: ''He appeared to be under the influence of alcohol.''
However, the case was not taken any further due to insufficient evidence.
