Madonna Sued Over 22 Year-old Hit Single 'Vogue'
The suit claims "The portions of 'Love Break', which have been copied into Vogue and all its various 'mixes,' 'remixes' videos, YouTube versions, etc. are numerous but intentionally hidden. The horn and strings in Vogue are intentionally sampled from 'Love Break' throughout." The music producer Richard 'Shep' Pettibone is named in the suit. He worked on various remixes of 'Love Break' and was also hired to work on 'Vogue.' They claim that he "intentionally disguised the sampling that he did in 'Vogue.'
Explaining why it has taken them so long to bring the case against Madonna, Vmg executives explain "The unauthorized sampling was deliberately hidden by [Madonna] within 'Vogue' so as to avoid detection. It was only when Vmg specifically looked for the sample, with the technology available to it in 2011, that the sampling could be confirmed." Vmg are now seeking compensation "in addition to Madonna's profits that are attributable to the copyrighted material." According to E! Online's report yesterday (July 12, 2012), Madonna's representatives are yet to comment on the case.
