Usher - Judge To Rule On Usher's Custody Battle

The Yeah! hitmaker is seeking sole custody of their two young sons amid allegations Foster has been trying to interfere with his visitation hours as outlined in a prior joint custody agreement.

Foster has denied the charge and the former couple, who divorced in 2009 after two years of marriage, has been fighting over the case in Fulton County court for months.

The latest hearing in the ongoing battle took place on Thursday, when Usher's lawyer claimed Foster was "incapable of being a proper parent" to little Usher V, four, and Naviyd, three, due to a lack of "emotional stability or capacity to bond with them".

Meanwhile, Foster's attorney argued the singer could not provide proper care and stability for the tots because he is always on tour, while he shares a strained relationship with his mother Jonetta Patton, who he listed as a member of his family unit.

Patton famously fell out with her superstar son over his decision to wed Foster, who is seven years his senior.

The custody battle has grown increasingly bitter over the past few months, with Usher accusing his ex of spitting on his girlfriend and throwing a plate of food at his car in a jealous rage. He also appeared to tear up when he was quizzed about his capabilities as a dad in May (12).

A judge is expected to reach a decision over custody within days.

The court fight is sure to have taken its toll on both Usher and Foster, who lost her 11-year-old son Kile Glover following a freak jet-ski accident in July (12).
