Halle Berry has "resolved things" with Gabriel Aubry.

The couple - who split up a year ago and have been involved in a public fight regarding the care of their three-year-old daughter Nahla - have now reached a point where they understand they had reached an "impasse" and needed assistance in their custody battle.

She said: "When there's a child involved, it's a relief when you can resolve things in a good way. Our issues were never about fighting for her. We both know a child needs both her parents. But what I want to say about it is sometimes, as a couple, you reach an impasse."

Halle - who stepped out with Kylie Minogue's ex-boyfriend Olivier Martinez in public for the first time on Sunday (17.04.11) - admits the couple need a court to sort out the fine details of their custody agreement.

She told Extra: "We need a court and a judge to help us work out some of the delicate issues, and I'm so happy we've arrived at that place because for her sake, this is the best way. We both love her more than life."

Earlier this week the Oscar-winning actress had announced she would no longer have her debut Broadway performance in 'Mountaintop'- due to begin a run in September - because of issues to do with her daughter.

A statement from producers said: "Halle will not be appearing in the role due to child-custody issues."
