According to a report by TODAY's Craig Melvin, investigators and prosecutors are considering criminal charges against the '30 Rock' actor after he was purportedly involved in an altercation with paparazzo Marcus Santos when he was leaving the New York City Marriage License Bureau with finacee Hilaria Thomas.
The Daily News reporter has filed an assault complaint with police, and according to a twitter post from Alec, Marcus went to hospital following the incident.
He wrote on the social networking site: ''The photographer who assaulted me has (belatedly) gone to a hospital claiming injuries.''
Should Alec be charged in relation to the altercation, lawyer Karen DeSoto expects his charge to be assault.
She told MSNBC: ''The obvious charge is assault. A lot of times in New York that will get downgraded to disorderly conduct as long as there is not substantial injury or intent to cause harm.''
But the 'Rock of Ages' star claims he was ''almost hit'' by a waiting photographer.
He tweeted: ''A 'photographer' almost hit me in the face with his camera this morning. #allpaparazzishouldbewaterboarded (sic)''
