REAL-LIFE CHARACTER IN TIMBERLAKE MOVIE LOSES APPEAL

The man whose alleged kidnapping and murder exploits inspired JUSTIN TIMBERLAKE's film ALPHA DOG has been denied an appeal.
California's High Court authorities have agreed Jesse James Hollywood can get a fair trial in an infamous 2000 slaying, despite the fact his crimes were heavily referenced in the 2006 movie, which also starred Bruce Willis and Sharon Stone.
Fugitive Hollywood was captured in Brazil after the film wrapped in 2005 and now Santa Barbara, California prosecutors have been given permission to proceed with the trial. He faces the death penalty if found guilty.
Hollywood is accused of orchestrating the kidnapping and murder of 15-year-old Nicholas Markowitz in August 2000.
Ron Zonen, the prosecutor in the case, originally agreed to co-operate with Alpha Dog director and screenwriter Nick Cassavetes in the hope that publicity from the film might help him find Hollywood.
The accused's legal team argued that Zonen and the Santa Barbara County district attorney’s office should be disqualified from the case, citing a conflict of interest.
California Supreme Court judges disagreed in May (08) and on Monday (20Oct08), the High Court turned down an appeal from Hollywood's lawyers.
Hollywood’s trial is scheduled to begin in February (09). Zonen will not be part of the prosecution.
Before the trial begins, a judge will also consider a motion to move the prosecution elsewhere.
Hollywood's associate, Ryan Hoyt, has already been convicted of Markowitz's murder and sentenced to death.
