CHRIS BROWN'S LAWYERS SEEK DISMISSAL OVER LEAKS

Legal representatives for Chris Brown are seeking to have the assault case against the singer dismissed over apparent leaks of classified information.

The Forever star is standing trial in Los Angeles accused of assaulting his girlfriend Rihanna on February 8th, the night of the Grammy awards.

Brown, 19, pleaded not guilty to two charges of assault and now his lawyers hope the online leak of a photograph of a bruised and battered Rihanna could derail the case against Brown.

The Los Angeles police department launched an internal investigation after a picture surfaced online of the Umbrella star with several facial injuries.

Brown's lawyer Mark Geragos told E! News: "The leaks can form the basis for a motion to dismiss the case in regards to outrageous governmental misconduct."

However, a defence attorney has disagreed with Geragos' claim that the leaked photograph could invalidate the entire case.

"If Geragos makes an issue of leaked evidence, it's unlikely the judge will dismiss the case," Jeffery Rubenstein told People.com.

"It's not police conduct at issue here, it's Chris Brown's."

It was yesterday agreed that Los Angeles police return jewellery taken from Rihanna as evidence on the night of Brown's alleged attack.

A preliminary hearing in the case is set for May 28th.
