Breaking Benjamin rocker Benjamin Burnley is suing two former bandmates over an allegedly unauthorised remix of one of the group's songs.
The group founder dismissed guitarist Aaron Fincke and bassist Mark Klepaski via email in May (11) after learning the pair had signed a deal with bosses at Hollywood Records to rework their hit track Blow Me Away.
Burnley claims he never gave his former bandmates permission to revamp the song and he is suing the pair for at least $250,000 (£156,250) in compensation and the exclusive use of the band name.
A judge in Luzerne County, Pennsylvania has ordered the case into arbitration.
Breaking Benjamin have been on hiatus since last year (10) due to a mystery illness which has been dogging Burnley in recent months.
Burnley and drummer Chad Szeliga are the only remaining members of the group.
