BIRKHEAD WANTS ARTHUR'S CUSTODY CASE DISMISSED
LARRY BIRKHEAD is hopeful a Bahamas judge will dismiss a legal bid launched by the mother of his late ex-girlfriend ANNA NICOLE SMITH challenging his custody of the model's daughter DANNIELYNN.
The photojournalist was granted custody of the tot in 2007 following the death of the tragic star, when a DNA test proved him to be her father.
But Birkhead faced competition from Smith's mother Virgie Arthur, who wanted to take care of the child herself.
She filed papers in a Bahamas court in 2007 countering the custody of Dannielynn, but the case has never gone to trial and Birkhead wants it to be dismissed altogether so he and his three-year-old girl can move on with their lives.
He says, "There's an open case in the Bahamas that's kind of laying dormant. It hasn't been dismissed but at this point Virgie's not in Dannielynn's life."
Smith died of an accidental drug overdose in February 2007.

When Larry gets grandchildren, he will understand how Vergie feels to not even
be able to see and love that precious baby who is all she has left of Anna. I
hope he reconsiders his decision to keep Vergie out of Dannielynn's life.
I think that Larry should have custody but I also know from my own life that my
grandmothers were as important to me as was my own Mom. Vergie should
definitely have visitation rights with Dannielynn for Dannielynn's sake. No
child can have too much love and with her Mom gone, Vergie is as close as she
can now get to her. Just my opinion.
