The family of the late rapper NOTORIOUS BIG was disappointed the other day as a judge dismissed its second wrongful death suit against the city of Los Angeles.

The presiding judge, Florence-Marie Cooper, ruled that the rapper's family did not file the claim against the city within the two-year time frame.

According to Fox 11 News, the trial, which was due to take place in February 2008, has now been delayed indefinitely.

BIG's family's attorney Perry Sanders Jr told the Los Angeles Daily Journal he "respectfully disagrees" with the ruling, but added it is too early to say whether the family will appeal.

The lawsuit alleges that NOTORIOUS BIG, real name CHRISTOPHER WALLACE, was murdered by Los Angeles police.

It claims that one of the officers was working for rival record company Death Row Records.

The rapper, who had hits with ONE MORE CHANCE and BIG POPPA, was gunned down on March 9th 1997 as he left a party at a Los Angeles museum.

Meanwhile, MARY J BLIGE, who collaborated with NOTRIOUS BIG on REAL LOVE is returning with a new single and album next year.

GROWING PAINS will be released on February 4th, closely followed by the single JUST FINE a week later.

The album has been produced by JAZZE PHA and TRICKY STEWART.
