BEATLES - MIAMI FIRM AGREES TO STALL BEATLES LOST PERFORMANCE ALBUM

LATEST: The bosses of an online music store have agreed to stall the release of an early BEATLES concert album until a legal battle with the Fab Four's record label is resolved.
Executives at The Beatles' Apple Records took legal action to stop bosses at Miami, Florida-based Fuego Entertainment from releasing the recordings earlier this year (08).
They claim The Beatles were already under exclusive contract to record label EMI at the time of the recordings, and so Fuego doesn't have the rights to release the tracks, which were taken from a performance at the Star Club in Hamburg, Germany in 1962.
The Apple executives are seeking at least $10 million (GBP5 million) in actual and punitive damages and an injunction preventing the recordings' release.
On Friday (04Apr08), a federal judge in Miami approved the agreement between Apple Corps Ltd. and Fuego Entertainment, Inc.
Eight unreleased tracks are said to be among the recordings, including a cover of Hank Williams' Lovesick Blues.
Fuego Entertainment lawyer Michael Joblove insists the agreement was voluntary and that his clients claim they acquired the legal right to market the recordings.
But Apple's attorney, Paul LiCalsi, says, "This clearly reflects that there is no basis for Fuego's claims that they have a right to exploit the tapes."
