Sixties hitmaker THE HOLLIES appeared in court yesterday (06JUL05) in a bid to have former bandmate ERIC HAYDOCK jailed for ignoring a previous court order not to use the band's name for his own projects.
London's High Court heard that Haydock, the HE AIN'T HEAVY, HE'S MY BROTHER stars' former bassist, his musical partner PETER HUGHES and promoter JAMES COZENS have staged concerts with a group called ERIC HAYDOCK'S HOLLIES, despite being told to use the titles "ex-Hollies" or "former Hollies bass player".
Remaining Hollies TONY HICKS, BOBBY ELLIOT, RAY STILES, IAN PARKER and PETER HOWARTH took out an injunction against Hayworth profiting from the band's name in 1988.
They cite several breaches of the court order including a 1999 tour of Australia, a show in Denmark last year (04) and a British tour - and prosecuting lawyer STEVEN GLOVER QC told MR JUSTICE ETHERTON that the only way to stop the breaches is to imprison all three men.
Haydock was a founder member of The Hollies in 1962, but left the band in 1966 - a year after the band had their first number one single I'M ALIVE.
