The results of soul star DIANA ROSS' breath tests can be used as evidence in her drink-driving case, an Arizona, America judge has ruled.
The BABY LOVE singer's lawyer STEPHEN PAUL BARNARD had attempted to have the TUCSON CITY COURT trial disregard the tests - which reportedly showed Ross had a blood alcohol concentration of 0.20 per cent compared to the Arizona legal limit 0.08 per cent - arguing police didn't have a search warrant and intimidated Ross.
However, City Magistrate T. JAY CRANSHAW ruled the evidence admissible, after viewing videotape of the incident - which he said showed that Ross was not scared.
The 59-year-old was arrested on 30 December (02), and police report Ross was unable to walk a straight line and fell while trying to stand on one leg and count to 10.
