A Malibu, California judge has once again declared a mistrial in the battery case against two surfers accused of assaulting several snappers who were following Matthew Mcconaughey.
Skylar Peak and Philip Hildebrand were arrested and charged with misdemeanour battery after confronting photographers as they tried to get shots of the actor on a Malibu beach in June, 2008.
The surfers allegedly threw one photographer into the water as he tried to shoot pictures, while another snapper claims he was attacked and his camera was thrown into the ocean by the pair.
The case went to court earlier this month (Jun10) but the jury failed to reach a verdict on Friday (18Jun10) and Malibu Superior Court Judge Lawrence Mira declared it a mistrial.
The surfers, who pleaded not guilty, are due to return to court on 2 July (10), when the prosecution will decide whether or not to retry the case.
The prosecution's previous attempt to hold the pair to justice in March (10) was deemed a mistrial after Peak's mother was seriously injured in a car crash.
