Kim Kardashian is pregnant with her and Kanye West's first child: that much we know, though by Californian law, the rapper will not breeze through all the relevant legal channels as the kid's father. In Kim's home state, the husband of a pregnant woman is presumed to be the father of the child and should Kris Humphries lay claim to the kid, Kim and Kanye would be forced to present "clear and convincing evidence" to a judge, reports TMZ.com.

That being said, it wouldn't be too hard for the couple to prove that Kanye is the father, given Kris and Kim haven't been together for over a year now. Speculation suggests the baby was probably conceived while Kim and Kanye were together in Rome around 3 months ago. Nevertheless, there is a "rebuttal presumption" currently working in Humphries' favor, which no doubt adds to the complexity of the former couple's on-going divorce. The legal back-and-forth continued in late 2012, with the Brooklyn Nets player refusing to grant Kardashian a divorce unless she admits their marriage was a fraud and returns the $2 million engagement ring he gave to her.

Kanye announced the couple's baby news during a show in Atlantic City on Sunday (December 30, 2012), as Kim watched on from the audience.
