The former child star-turned-producer created the show for executives at his old network after they asked him to come up with a live action comedy, but the show has failed to take off in America and now Fox chiefs are ready to cancel it.
A spokesman for the show tells WENN, "Fox bought Sons of Tucson in the hope of resurrecting the genre for the network and hoped to eventually build out a live action comedy block night. They looked to Justin and the Malcolm creative team to do just this.
"They bought the show to put on at 8.30pm and despite initial audience testing results reporting against it, the network top brass decided to put Sons of Tucson on much later at 9.30pm, which draws a much different, less family audience. How does a family show do during a non-family hour? Well... not good.

Doris Payne, 79, attempted to leave a Saks Fifth Avenue store on Friday (22Jan10) without paying for a $1,300 (£8,125) Burberry trenchcoat.
Payne, who was on parole for past thefts when she was caught, is currently in custody without bail.

The actor/producer bought the Calabasas, California home when the pop couple split after filming their reality show in the house.
Speaking to WENN in 2007, Berfield revealed the pad was his dream home long before it became a reality TV den - he first visited the five-bedroom mansion when he was a teenager.
He explained, "I'd actually been to that house about three years before I bought it and I thought it was an amazing house and I only hoped back then that one day I could have a house like this. It just had everything I wanted in a house."

Berfield and his company J2 Pictures are being sued by bosses at distribution firm Essential Entertainment - who claim they have been left $150,000 (GBP75,000) out of pocket after plans for the movie fell through.
The lawsuit, filed at Los Angeles Superior Court, alleges that Essential Entertainment has been stuck with thousands of dollars of expenses after the film - which was to be directed by Oscar-winner Oliver Stone - was shelved, according to TMZ.com.
Berfield's firm previously produced Jessica Simpson's 2007 flop Blonde Ambition.

LATEST: Actor/producer Justin Berfield has confirmed he'll be heading into space on entrepreneur SIR Richard Branson's inaugural Virgin Galactic flight, revealing Madonna could be sitting next to him.
The former Malcolm In The Middle star, a pal of Branson's, plans to turn his brief space adventure into a new book.
Berfield's spokeswoman says, "Justin considers Branson a genius and is one of the few people that he would follow just about anywhere.
"He's a frequent guest at Branson's ultra luxury island home, Necker, in the British Virgin Islands, and now he's heading into space."

The 22-year-old actor has reportedly paid $250,000 (GBP125,000) for a seat on a Virgin Galactic space flight.
Berfield, whose production company J2TV reportedly has links to Branson's charity Virgin Unite, is one of a number of celebrities linked to the first space trips; former Star Trek star William Shatner, rockers Dave Navarro and Moby, actress Victoria Principal and astrophysicist Stephen Hawking are all hoping to take off with Branson.
Those with enough money for a seat will get to experience five minutes of weightlessness during a two-and-a-half hour flight miles above the earth.

Former Malcolm In The Middle star Justin Berfield is suing a Los Angeles construction firm for turning his old home into a mould-infested wreck.
The actor, who now lives in pal Jessica Simpson's former home in Calabasas, California, claims he suffered respiratory problems while living in the Studio City home.
He is suing Shell Burton Construction over what he says was faulty work the company did on the home, which once belonged to George Clooney.
In a lawsuit, obtained by TMZ.com, Berfield alleges he learned his former home was infested with mould when he tried to sell the house.
Berfield is suing for negligence, breach of warranty and breach of contract, and is asking for damages in excess of $1 million (GBP513,000).

The 21-year-old former Malcolm In The Middle star secured the rights to 76-year-old Payne's life story after meeting the thief in prison. He then commissioned seasoned writer EUNETTA T. BOONE to pen a screenplay.
Payne, who is known as The Grandmother Thief, has spent much of her adult life pulling off some of the biggest gem heists around the globe.
Berfield has yet to confirm if the MovieHole.net reports about Oscar winner Berry are true, but says, "Doris was a jewel thief for six decades and worked all over the world. Doris is a magnificent woman and she's incredibly intelligent.
"Whoever plays her will have to be able to leave the audience with several questions concerning Doris' state of mind. It's a very demanding role."
