A concertgoer left horribly injured after a fellow reveller landed on him following a 30-foot (9.14-metre) fall during a gig by French electro duo Justice is suing for damages.
Yosef Allen, 24, was attending the concert at New York's Hammerstein Ballroom last October (12) when an unnamed fan fell from a second floor balcony.
Allen took the full brunt of the man's fall and was left with back, neck and head injuries.
He claims he was forced to take six months off work to focus on his recovery, and has now filed suit against bosses of the venue for "permitting concertgoers to be unruly; in permitting excessive amounts of alcohol" and "failing to furnish proper guardrails on the upper levels and balconies".
The man who caused the injuries, and was escaped without a scratch, is also targeted in the lawsuit, but is referenced in legal papers as John Doe.
Allen is seeking unspecified damages.
