Johnny Depp and his trendy Los Angeles club THE VIPER ROOM are in trouble after security guards allegedly beat up an innocent reveller.

RORY SMITH claims he and his mother were enjoying a night out at the club in June (03) when three over-zealous bouncers punched and kicked him to the ground, while his mother begged them to stop.

Smith claims he was forcibly removed from the premises after he climbed onto the stage to get easy access to an exit. In his lawsuit he alleges he was "picked up, carried outside and thrown to the sidewalk", where three bouncers beat him up.

A legal spokesman for Smith says, "We're suing the security there, The Viper Room and Johnny Depp because his name's attached to the club and he has some responsibility."

The club on Sunset Boulevard gained frenzied press attention in 1993, when actor River Phoenix died on the pavement after taking a lethal concoction of drugs in the venue.
