After amicably splitting from her husband Mike Comrie after three years of marriage in January 2014, Hilary Duff has finally filed divorce papers to officially make her a single lady once again.

According to TMZ, the 27-year-old actress, who has hired celeb attorney Laura Wasser to represent her, cited irreconcilable differences as the reason for their failed marriage and is requesting primary physical custody of their son Luca, who turns 3 next month.

Duff's decision to file the documents comes after Comrie, a former NHL player, reportedly got very drunk while on a night out in everly Hills, Calif., where he was apparently chatting up waitresses at swank eatery Mastros.

The gossip site also claims that the 'Lizzie McGuire' star also wants Comrie to have visitation rights, but sources have revealed that she is very concerned about the effect his partying lifestyle will have on their young son.

Although the duo were separated for quite some time, the divorce news is rather surprising as they have been spotted together over the past several months and even went on vacation with one another.

During an interview with Health magazine's December issue, Duff hinted that their marriage wasn't totally a lost cause.

"We really didn't see it going any other way," she told the mag. "We have a 2-year-old together. We love each other. Obviously it wasn't a rash decision that we made. We really are just trying to figure out how we are the most happy - whether together or apart - and we're doing it as lovingly as possible."
