* BERNIE MAC HOSPITALISED WITH PNEUMONIA Comedy actor BERNIE MAC is being treated for pneumonia in a Chicago, Illinois hospital. A representative for the 50-year-old Ocean's Eleven star insists he is already beating the deadly illness, and confirms it isn't linked to tissue inflammation disease sarcoidosis, which Mac has suffered for the past 20 years. Danica Smith tells the Chicago Sun-Times, Mr. Mac is responding well to treatment. He asked that his privacy and that of his family is respected while he gets well. He's doing great and hopes to get out soon. He's Bernie - he's one of the best guys you'll meet. Smith did not know when Mac was admitted to hospital, but confirmed his wife Rhonda McCullough has been at his bedside. The couple has been married for 31 years and has a 30 year old daughter and one granddaughter. As WENN goes to press, no further details are available. * LaBEOUF ARRESTED FOR DUI Actor SHIA LaBEOUF has reportedly been arrested in Hollywood for driving under the influence (DUI) after he was involved in a car accident. The Transformers star, 21, is alleged to have collided with another vehicle at around 3am on Sunday (27Jul08) at the junction of La Brea and Fountain. According to website TMZ.com, when police attended to the incident, LaBeouf was reportedly arrested on suspicion of felony DUI after showing outward signs of intoxication. Paramedics were called to the scene and the actor was taken to a local hospital. LaBeouf is no stranger to the law - in November (07), he was accused of drunken trespassing after refusing to leave a Chicago, Illinois convenience store at 4am, but the misdemeanour charges were subsequently dropped. Then, in February (08), he was charged with smoking in a prohibited area in California - to which he pleaded guilty and was forced to pay a $500 (£250) fine for the offence. His latest legal woe comes just three months after he vowed never to get arrested again - because he didn't want to hamper his promising film career. In May (08), he said, There's nothing cool about getting arrested for stupid stuff at my age. But it keeps happening to me. I could pretend that I find it all highly amusing, but I'd be lying. It's deeply embarrassing. I decided a long time ago to stop doing stupid things, so clearly I've still got some work to do on myself. I'm not anonymous any more. Now, I light up a cigarette in the wrong place and overnight I'm the Al Capone of misdemeanours. What I've got in terms of acting is too important for me to jeopardise. (MT/WNWCZM)

KELLY has been ordered to cancel a Virginia concert scheduled to take place a day before his January (08) hearing at a Chicago, Illinois, court. The Bump N' Grind singer is due to stand trial for 14 child pornography charges in May (08), but has to attend another hearing on the case on 14 January. And Judge Vincent Gaughan is taking no chances with Kelly after he failed to turn up to court earlier this month (19Dec07) - he's insisted the star postpones his 13 January gig at Virginia's Hampton Coliseum to ensure there will be no problems getting to court on time. Kelly narrowly avoided arrest on 19 December after skipping the scheduled court date following a hold up in Utah, where he was touring.
