Playboy Sues Harper's Bazaar Over Racy Kate Moss Photos Claiming Copyright Infringement

Playboy have filed a lawsuit against Harper's Bazaar publisher, Hearst Communications, for using photos of Kate Moss without their consent.

The racy snapshots were posted on their website accompanied with a link that read, "See Kate Moss' Full Fab Playboy Spread."

Visitors to the site, who clicked on the link, were directed to another website called Entertainment.ie with a piece of text that said, "Save yourself a fiver. Here's Kate Moss' NSFW spread from Playboy."

Only nine of the photos, which were taken by famed fashion photographers Mert Alas and Marcos Piggott from Playboy's 60th anniversary issue, from the magazine's spread could be viewed.

The court papers were filed on Friday (Jan 17th) in a Manhattan court and claim Harper's Bazaar breached Playboy's exclusive rights to be the soul publisher of the photographs.

The documents stated, "Hearst's link to the Entertainment.ie website page cannot be justified by any suggestion that Hearst was reporting the news of Ms. Moss's appearance in the 60th Anniversary Issue," (via NY Daily News).

Playboy acknowledged that they "welcomed the media's reporting and discussion of its images," but Hearst "well exceeded the bounds of mere news reporting" in a blatant effort "to attract and drive Internet visitor traffic," the suit also read.

Even though both links have been removed, Playboy still want to be compensated and are demanding $150,000 for each piece of "infringed work, " resulting in Hearst Communication's paying the adult magazine approximately $1.35 million.

As well as been featured for the mag's 60th anniversary the British supermodel was also celebrating her 40th birthday.
