Aaliyah's record label BLACKGROUND RECORDS cannot sue the video producer who arranged the flight that killed the late R+B singer.

The TRY AGAIN singer had just finished filming the video for rock the boat in the Bahamas and was killed alongside eight others when their Cessna airplane crashed after take-off for Florida.

An autopsy found both cocaine and alcohol in the pilot's body, while an investigation stated the plane was overloaded by 317 kilograms (700 pounds).

A Manhattan, New York, appeals court ruled on Thursday (06JAN05) only Aaliyah's parents MICHAEL and DIANA HAUGHTON had a right to sue the producer for her wrongful death.

In 2003, the Haughtons filed papers in a Los Angeles court saying they had reached a settlement with the plane's owners, operator and flight broker.
